Implement the vision, strategy and direction of the Dispute Resolution Team ("DRT").
Support and work in close collaboration with Greater China & North Asia (GCNA) Regional General Counsel ("RGC") and members of the Government Investigations Legal ("GIL") team in relation to Major Disputes and cross border orders
Manage assigned Major Disputes, cross-border orders and, where appropriate, investigations, across the Group's global network.
Key Roles and Responsibilities
Lead on the management of assigned Major Disputes (qualification for this category being measured by potential financial exposure and/or potential significant reputational or commercial risk), cross border orders and, where appropriate, investigations within GCNA and across the Group's global network.
Collaborate and work closely with the GCNA RGC and the Regional Legal team supporting the management of Major Disputes, taking into account the need for consultation on regional and local legal issues, management of senior stakeholders regionally and globally and management of the risks involved. Act as a trusted and "go to" adviser and as a senior point of contact for dispute resolution related advice and expertise, particularly within GCNA.
Provide relevant stakeholders, particularly the GCNA RGC and GIL with accurate and timely information regarding the status of assigned Major Disputes, cross-border orders and investigations.
Assume responsibility for providing legal advice, guidance and support to stakeholders across the Group on the management and conduct of assigned Major Disputes, cross border orders and investigations.
Anticipate and proactively provide legal advice, guidance and support for assigned projects and initiatives aimed to reduce and mitigate risk in contentious cases.
Maintain close relationships with the Group's businesses and support functions (as DRT and RGC stakeholders), in order to provide them with relevant legal advice, guidance and support on disputes or investigations related matters (including on how to mitigate the risk of disputes arising).
Supervise and provide necessary support to reports on their assigned matters.
Promote a culture and practice of compliance with legal standards (including conducting business within legal and regulatory requirements and with high ethical standards) within the Group.
Lead through example and build appropriate culture and values. Set an appropriate tone and expectations for reports as regards good conduct.
Comply with the Group Code of Conduct.
Manage Employee Development and Engagement
Provide leadership, management and coaching to direct reports to enable them to be fully engaged and performing to their potential.
Ensure that reports are objectively and fairly assessed against their responsibilities and objectives, including obtaining feedback from relevant stakeholders and, working with the Global Head, Legal, Dispute Resolution to endeavour to ensure that direct reports are objectively and fairly assessed and rewarded against their responsibilities and objectives.
Seek to support reports' development, including through training and supporting their participation in external networks.
Set and monitor job descriptions and objectives for reports.
Engage in the process for the implementation of matter observations.
Manage Conduct and Risk
Display exemplary conduct and live by the Group's values and Code of Conduct.
Take personal responsibility for embedding the highest standards of ethics, including regulatory and business conduct, across the Group. This includes understanding and complying with, in letter and spirit, all applicable laws and regulations of which he/she is aware or should reasonably be aware, and the Group Code of Conduct.
Support the DRT and GCNA RGC to achieve the relevant outcomes set out in the Group's Conduct Outcomes, including Financial Crime Prevention and The Right Environment.
Effectively and collaboratively identify, escalate, mitigate and resolve risk, conduct and compliance matters.
Assist the Global Head, Legal, Dispute Resolution, the GCNA RGC and GIL with reporting to key risk control committees and management groups on relevant legal risks and issues, including through the drafting of relevant reports on assigned matters.
Proactively participate in regular GCNEA Legal team meetings.
Have an awareness and understanding of the regulatory framework in which the Group operates, and the regulatory requirements and expectations relevant to the role.
Work with any local regulators (when required to do so on assigned matters) in an open and cooperative manner.
Where external counsel is appointed, ensure the DRT liaises with external counsel to ensure the scope of work is defined and appropriate, the quality of work is overseen effectively, legal costs are managed, and there is appropriate overall matter management.
The remit of this role does not extend to Employment or Tax disputes.
Qualifications and Skills
Qualified to practice as a solicitor/attorney or barrister/advocate.
Experience of managing complex legal disputes and investigations in private practice or in-house, including within GCNA.
Sharp business acumen (including ability to assess risk and appropriate levels of return), strong leadership qualities, excellent interpersonal skills and multicultural awareness and sensitivity.
Sound judgment of business practices, regulatory relationship management and reputational risk.
Exemplary integrity, ethics, independence and resilience.
Proven ability to establish relationships and provide strong direction at senior levels of the Group and with external stakeholders.
